Questions over what will happen to Prince Harry’s US visa status will soon be answered after a US judge ruled that the documents must be made public by Tuesday. Judge Carl Nichols, who set today’s deadline, approved the redactions suggested by the Department of Homeland Security (DHS), describing them as “appropriate”, as per the Daily Mail.

It remains unclear which documents relating to the Duke of Sussex’s relocation to the United States will be released, however, it has been reported that three items will be shared in a redacted form, while a fourth will remain private. It is thought that the documents will shed light on the answer Prince Harry gave about any personal drug use when asked if he was a drug user on visa application forms.

In his bombshell memoir Spare, which was released in January 2023, Harry made claims about his recreational use of cocaine, magic mushrooms and marijuana, as well as psychedelics such as ayahuasca, as a form of therapy.

On whether the documents will reveal anything, the right-wing US Heritage Foundation think tank claimed that an admission of drug use should have disqualified the Duke from getting a US visa.

The group has since been trying to find out whether Harry did not disclose the information, or whether he received a special waiver from former US President Joe Biden’s administration.

Judge Nichols, who was appointed by US President Donald Trump, was quoted as saying: “The government has provided the court with its proposed redactions to the documents… those redactions appearing appropriate, the government is ORDERED to lodge on the docket the redacted versions of those documents no later than March 18, 2025”.

In previous legal filings, DHS said that the records at issue are “particularly sensitive” because they would “reveal Harry’s (immigration) status in the United States.” The DHS wrote: “Even though he is a public figure, Prince Harry still maintains a privacy interest in these types of records and in his immigration or visa status generally. Even if public figures may have a diminished expectation of privacy, they do not surrender their privacy interests entirely.”

US immigration laws state any foreigner “determined to be a drug abuser” is classed as “inadmissible”. However, officials are afforded discretion to waive the rule.

However, back in February, President Donald Trump explained that he would not order the Prince to leave the US in a harsh statement against Meghan Markle.

He told the New York Post he will not order Harry out of the US, saying “he’s got enough problems with his wife”, who he described as “terrible” after the Duchess of Sussex alleged the president was “divisive” and “misogynistic”.
